Terms and Conditions

These terms govern the Obiklip website, desktop application, account and processing service provided by Man Sarip, the developer and operator of Obiklip ("Obiklip", "we", "us").

1. Agreement and eligibility

By downloading or using Obiklip, creating an account or buying processing minutes, you agree to these terms and our Privacy Policy. Do not use the service if you do not agree. You must be at least 18 years old and able to enter a binding contract. If you use Obiklip for an organisation, you confirm that you may bind it to these terms.

2. The service

Obiklip helps turn spoken video into proposed short clips, transcripts, subtitles and titles. Source video, project editing and rendering remain on your computer. Online processing is needed for transcription and AI suggestions. Features, supported formats and system requirements are described in the documentation and may change as the product develops.

AI and speech recognition can be incomplete, inaccurate or unsuitable. Suggested clips, words, timing, scores and titles are starting points, not professional advice or a promise of audience performance. You are responsible for reviewing every output before relying on or publishing it.

3. Accounts

Provide an email address you control and accurate information. Keep the password and device session secure. You are responsible for activity under your account unless you promptly report unauthorised access. One person or organisation may not create accounts to evade limits, obtain repeated trials or avoid a suspension.

The free trial is offered once per eligible person or email identity, may be withheld from disposable or uncertain addresses, has no cash value and may be changed or ended for future users. Trial minutes already credited are not affected unless obtained by fraud or abuse.

4. Your recordings and permissions

You retain your rights in recordings, transcripts, edits and exports. You give Obiklip only the limited permission needed to transmit and process audio, text and instructions to provide the feature you request. This permission ends when that processing is complete, subject to the temporary provider retention described in the Privacy Policy.

You must have all rights, notices and consents needed to:

possess, download, copy, edit and publish the recording;
process the voices, names, images and other personal data it contains;
use any music, artwork, brands or other protected material; and
send the necessary audio and text to the service providers named in the Privacy Policy.

Importing a public link does not mean the owner has permitted a download or reuse. You must comply with the source website's terms and applicable copyright, privacy, confidentiality, employment and recording laws. Do not submit highly sensitive or regulated content unless you have assessed the risk and have authority to use the listed providers.

5. Licence

Obiklip grants you a limited, revocable, non-exclusive, non-transferable licence to install and use the application for your own personal, business or client work while you comply with these terms. You may use exported clips commercially if you hold the necessary rights in their content.

You may not sell, sublicense, redistribute or impersonate Obiklip; remove ownership notices; bypass billing, security or usage limits; introduce malicious code; or reverse engineer the service except where applicable law expressly permits it.

6. Processing minutes

One minute means one minute of source video analysed, rounded up per recording.
The app shows the required minutes before an analysis starts.
Minutes are reserved at the start and spent after successful analysis.
A failed or cancelled analysis releases its reserved minutes automatically.
Re-analysis is a new charge. Editing, subtitles and export do not spend minutes.
Paid minutes do not expire, but are not money and cannot be transferred between accounts.

Local projects do not sync between computers. Importing and analysing a recording on a different computer may therefore spend minutes again. A future price change applies to new purchases only and will not reduce minutes already credited.

7. Prices and payment

Prices are displayed in US dollars. The checkout shows the final amount, payment method, currency conversion where relevant and any applicable tax before you pay. There is no subscription or automatic renewal.

Lemon Squeezy acts as merchant of record and processes the purchase under its buyer terms and privacy policy. Obiklip receives confirmation and order details, not your card number. Minutes are credited after payment confirmation. Contact support if a confirmed payment is not reflected after refreshing the balance.

8. Refunds

For a change of mind, email support@obiklip.com from the account address within 3 calendar days after purchase. Only paid minutes from that purchase which remain unused when the request is processed are eligible. The refund is 50% of the price attributable to those unused minutes, and all unused minutes covered by the approved request are removed from the account.

Example: 300 minutes cost USD 15. If 100 have been used, 200 remain eligible. The change-of-mind refund is 50% of their USD 10 value: USD 5. The remaining 200 minutes are removed. Tax adjustments are handled by the payment provider.

Minutes spent on a completed analysis are used even if you dislike an AI suggestion. A failed analysis returns its minutes and does not by itself create a cash refund. Refunds are issued through the original payment method. Processing time and any provider rules may apply. If a refund, reversal or chargeback exceeds the available balance, the balance may become negative and further analysis may be blocked until it is restored.

This change-of-mind policy does not exclude any refund, repair, repeat performance or other remedy required by Malaysian consumer law or other mandatory law. Where such law applies, it prevails over any inconsistent part of these terms.

9. Acceptable use

You must not use Obiklip to:

break the law or another person's intellectual-property, privacy or contractual rights;
create deceptive, defamatory, abusive, exploitative or harmful material;
process material obtained through unauthorised access or unlawful surveillance;
attack, overload, scrape, probe or disrupt the application, API or another system;
share an account in a way that compromises its security; or
evade charges, trial rules, technical restrictions or enforcement action.

We may restrict processing, suspend an account or remove access where reasonably needed to investigate or stop misuse, security threats, non-payment or a material breach. We will give notice where reasonably practicable and law permits.

10. Intellectual property and feedback

The Obiklip application, website, branding, documentation and service are owned by Obiklip or its licensors. No ownership transfers to you. To the extent permitted by law, you may use AI-generated suggestions returned for your content, but similar or identical material may be generated for others and exclusive rights are not guaranteed.

If you send feedback, you allow us to use it without restriction or payment, but we do not obtain ownership of your recordings or projects.

11. Availability, updates and third parties

We aim to keep the service available but do not promise uninterrupted or error-free operation. Processing can depend on internet access and third-party providers. We may maintain, change, limit or discontinue features. If a discontinuation materially affects unused paid minutes, we will provide a reasonable way to use them or an appropriate remedy.

The current Early Access installers are not code-signed or notarised and the operating system may warn or block them. Follow the official installation instructions, download only from the Obiklip website and verify the published checksum where appropriate.

12. Disclaimers

To the maximum extent allowed by law, Obiklip is provided on an "as available" basis. We do not guarantee transcription accuracy, clip quality, compatibility with every recording or platform, uninterrupted availability, preservation of local files, or any audience, income or business result. Keep your own copies of source recordings, exports and important project data.

Nothing in these terms excludes guarantees, warranties or remedies that cannot lawfully be excluded, including rights under the Consumer Protection Act 1999 where applicable.

13. Liability

To the maximum extent allowed by law, Obiklip is not liable for indirect, incidental, special or consequential loss, loss of profit, audience, opportunity or data, or claims arising from content you lacked permission to use. Obiklip's total liability relating to the service is limited to the amount paid for Obiklip during the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or any liability that law does not allow us to limit.

14. Closing an account

You may request account deletion by emailing support from the account address. Deletion does not remove local projects, source videos or exports. Unless mandatory law requires otherwise, unused trial and paid minutes are cancelled without refund when the account is deleted. Submit any eligible refund request before requesting deletion.

Provisions which by their nature should continue—including ownership, payment, disclaimers, liability, disputes and surviving data obligations—remain effective after account closure.

15. Changes

We may update these terms. The date above will change, and material changes will be brought to account holders' attention where reasonably practicable. Changes do not retrospectively reduce the number of paid minutes already credited. Continuing to use the service after revised terms take effect constitutes acceptance where permitted by law.

16. Malaysian law and disputes

These terms are governed by Malaysian law. Contact support first so we can try to resolve a dispute. Subject to any consumer's right to use the Tribunal for Consumer Claims or another competent forum, the courts of Malaysia have jurisdiction. Mandatory protections in your place of residence remain unaffected where they apply.

17. General

If a provision is invalid or unenforceable, it is limited or removed only as necessary and the rest remains effective. A delay in enforcement is not a waiver. You may not transfer these terms without our consent; we may transfer them with the business or service, subject to applicable law. These terms, the Privacy Policy and the terms shown at checkout form the agreement concerning Obiklip.
