Terms and Conditions

These terms govern the Obiklip website and web application, provided by Man Sarip, the developer of Obiklip ("Obiklip", "we", "us").

1. Agreement and eligibility

By using Obiklip or supporting Obiklip, you agree to these terms and our Privacy Policy. Do not use the service if you do not agree. You must be at least 18 years old and able to enter a binding contract. If you use Obiklip for an organisation, you confirm that you may bind it to these terms.

2. The service

Obiklip runs on your own AI API key. AI requests are sent directly from your browser to OpenAI and billed to your OpenAI account. Obiklip holds no API key of its own, makes no AI request on your behalf and sells no processing credit. All features are free, and financial support is optional.

Obiklip is a static web application. There is no Obiklip server, no account and no database: nothing you do in the app is sent to us or recorded by us.

Obiklip helps turn spoken video into proposed short clips, transcripts, subtitles and titles, translations and post copy. Source video, project editing and rendering remain on your computer. Internet access is needed for transcription and AI suggestions. Features, supported formats and system requirements are described in the documentation and may change as the product develops.

AI and speech recognition can be incomplete, inaccurate or unsuitable. Suggested clips, words, timing, scores and titles are starting points, not professional advice or a promise of audience performance. You are responsible for reviewing every output before relying on or publishing it.

3. Your API key

Your OpenAI API key is kept in your own browser and sent only to OpenAI. Keep it secure. You manage your OpenAI account, API billing, model access and usage limits under OpenAI's terms. Removing a key from Obiklip does not revoke it at OpenAI; revoke it through OpenAI if you want to stop its use.

4. Your recordings and permissions

You retain your rights in recordings, transcripts, edits and exports. Obiklip receives none of them. You give Obiklip only the limited permission needed for the app, running in your browser, to transmit audio, text and instructions to OpenAI to provide the feature you request.

You must have all rights, notices and consents needed to:

• possess, download, copy, edit and publish the recording;
• process the voices, names, images and other personal data it contains;
• use any music, artwork, brands or other protected material; and
• send the necessary audio and text to OpenAI.

A recording being publicly available does not mean its owner permits copying or reuse. You must comply with the source website's terms and applicable copyright, privacy, confidentiality, employment and recording laws. Do not submit highly sensitive or regulated content unless you have assessed the risk and have authority to use OpenAI for it.

5. License

Obiklip grants you a limited, revocable, non-exclusive, non-transferable license to use the application for your own personal, business or client work while you comply with these terms. You may use exported clips commercially if you hold the necessary rights in their content.

You may not sell, sublicense, redistribute or impersonate Obiklip; remove ownership notices; introduce malicious code; or reverse engineer the service except where applicable law expressly permits it.

6. Free access

All Obiklip features are free. No account, license key or payment is required, and there is no daily analysis quota. Browser, hardware and API provider limits still apply.

7. Optional support

You may optionally support Obiklip. Payment is made on a page hosted and operated by Stripe, under Stripe's own terms. A support payment is a one-time voluntary contribution: it creates no subscription, buys no feature access and buys no AI usage. Obiklip receives no card details and no record of the payment.

Your API provider bills you directly. Requests already processed may still incur charges if a task fails or is cancelled.

8. Refunds

Because support buys nothing, there is nothing to cancel and no access to lose. For a change of mind, message @mansarip on Telegram within 14 calendar days of payment, with the receipt Stripe sent you, and a full refund will be issued to the original payment method. Provider processing times may apply.

API provider charges are separate and cannot be refunded by Obiklip. Mandatory consumer rights are unaffected.

9. Acceptable use

You must not use Obiklip to:

• break the law or another person's intellectual-property, privacy or contractual rights;
• create deceptive, defamatory, abusive, exploitative or harmful material;
• process material obtained through unauthorised access or unlawful surveillance;
• attack, overload, scrape, probe or disrupt the website, the app or another system; or
• evade technical restrictions or enforcement action.

10. Intellectual property and feedback

The Obiklip application, website, branding, documentation and service are owned by Obiklip or its licensors. No ownership transfers to you. To the extent permitted by law, you may use AI-generated suggestions returned for your content, but similar or identical material may be generated for others and exclusive rights are not guaranteed.

If you send feedback, you allow us to use it without restriction or payment, but we do not obtain ownership of your recordings or projects.

11. Availability, updates and third parties

We aim to keep the site and the app available but do not promise uninterrupted or error-free operation. Processing depends on internet access and on OpenAI. We may maintain, change, limit or discontinue features. Because nothing is sold and no payment unlocks a feature, a change or discontinuation creates no refund entitlement; mandatory consumer rights are unaffected.

The app depends on browser capabilities for local files, decoding and rendering. Browser updates, permission changes and storage clearing may affect local access.

12. Disclaimers

To the maximum extent allowed by law, Obiklip is provided on an "as available" basis. We do not guarantee transcription accuracy, clip quality, compatibility with every recording or platform, uninterrupted availability, preservation of local files, or any audience, income or business result. Your projects exist only in your browser and nowhere else, so keep your own copies of source recordings, exports and important project data.

Nothing in these terms excludes guarantees, warranties or remedies that cannot lawfully be excluded, including rights under the Consumer Protection Act 1999 where applicable.

13. Liability

To the maximum extent allowed by law, Obiklip is not liable for indirect, incidental, special or consequential loss, loss of profit, audience, opportunity or data, or claims arising from content you lacked permission to use. Obiklip's total liability relating to the service is limited to the amount paid to Obiklip during the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or any liability that law does not allow us to limit.

14. Stopping

There is no account to close. Stop using Obiklip whenever you like. To remove your data, delete your projects in the app or clear the site's data in your browser; both are permanent, because no copy exists anywhere else. Revoke your API key through OpenAI.

Provisions which by their nature should continue - including ownership, disclaimers, liability and disputes - remain effective after you stop using Obiklip.

15. Changes

We may update these terms. The date above will change. A change never turns a free feature into a paid one retrospectively, and it does not affect a support payment already made. Continuing to use the service after revised terms take effect constitutes acceptance where permitted by law.

16. Malaysian law and disputes

These terms are governed by Malaysian law. Get in touch first so we can try to resolve a dispute. Subject to any consumer's right to use the Tribunal for Consumer Claims or another competent forum, the courts of Malaysia have jurisdiction. Mandatory protections in your place of residence remain unaffected where they apply.

17. General

If a provision is invalid or unenforceable, it is limited or removed only as necessary and the rest remains effective. A delay in enforcement is not a waiver. You may not transfer these terms without our consent; we may transfer them with the service, subject to applicable law. These terms and the Privacy Policy form the agreement concerning Obiklip.
